Here, I reported that SME countersued Yellowstone Valley Electric. One of my concerns at the time was whether the city of Great Falls/ECP was involved in this countersuit.
According to the document, the city/ECP is not listed as a defendant. In fact, one of their arguments is that ECP is not the member of Southern Montana, but that the City of Great Falls is.

Actually, Electric City Power is a named defendant in the suit.
Named as a defendant individually, and as a member, it appears. Defendants (SME) affirmatively allege that the City of Great Falls is the member and thereafter refer to said defendant as "Electic City Power (or City of Great Falls)".
As Geeguy has said, ECP is the 'alter ego' of the city...both cut from the same 'ignorant' cloth....except for a few brave
and outspoken board and commission members...
ECP is a separate legal Montana corporation and is not a member of either SME's. Yellowstone sued the wrong entity as far as ECP is concerned and needs to amend their suit to name the city of Great Falls which IS the SME voting member.
What a confusing mess the city has gotten us all into and we have the old guard city commission and ex city manager John Lawton to thank for this fiasco.......
